Class Action against Woolworths Group Ltd

Background

Litigation Lending is funding a class action filed by Dutton Law against Woolworths Group Ltd (ASX:WOW) on behalf of shareholders who acquired Woolworths shares between 26 February 2010 and 8 September 2025, who may have suffered loss as a result of Woolworths' conduct during that period.
 
During the Relevant Period, Woolworths failed to record and pay entitlements due to many of its salaried employees, which it has acknowledged, to a certain extent, through a number of disclosures to the market.  The recovery and quantification of further entitlements due to employees is the subject of a separate class action.

In summary, this class action alleges that Woolworths engaged in misleading or deceptive conduct and other contraventions by publishing financial statements during the Relevant Period that overstated Woolworths’ financial results, including by understating expenses (i.e. by not recording and reporting the entitlements due to those employees) and thereby overstating profits, causing the price of its shares to be artificially inflated.

The proceedings are filed in the Federal Court, with proceeding number NSD1995/2025.

How much will it cost to be part of the class action?

Registering for the class action is free, and there will be no ‘out of pocket’ costs which group members have to pay by participating in the class action.

The class action is funded by a third-party litigation funder, Litigation Lending Services.  This means that you will not have to pay any money out of your own pocket for legal fees or related expenses and you will not be responsible for paying any costs if the class action is unsuccessful.

If the class action is successfully resolved and there is a recovery of compensation, the funder will be entitled to reimbursement of the costs it has paid plus a commission.  These amounts will never exceed the compensation to which you may otherwise become entitled, and must be approved by the Court to ensure any amounts deducted from the recovery are fair and reasonable.
